Ormond Beach man charged with criminal mischief after throwing cell phone at passing car

Dec. 21

Fists at the ready

1:48 p.m. — 100 block of South Nova Road, Ormond Beach

Breach of peace. Police responded to a fight at a local fast food restaurant after a witness spotted a man get out of a car in the drive-thru and start hitting the window of a truck which was also in line.  

The witness reported that the man, a 33-year-old from Daytona Beach, who was a passenger in the car, left soon after the altercation as the driver apologized to the truck owner. The driver told police that the man was her friend and that he appeared to be under the influence of some narcotic "as she saw his eyes flickering and he was acting strangely," according to a police report. She said the man started insulting the truck owner and trying to instigate a fight with him after he got out of her car to look for his cigarettes. 

The truck owner told police he had no idea why the man began insulting him. He declined to press charges. 

The man was located near a retail pharmacy store. He told officers that he had not used any drugs, but that he also could not recall the incident. He was taken to jail.

Charges thrown his way

7:31 p.m. — Intersection of Fleming Avenue and South Nova Road, Ormond Beach

Criminal mischief. Police arrested a 40-year-old Ormond Beach man who threw a cellphone at a passing car, resulting in a shattered windshield. 

According to a police report, the driver of the vehicle reported she had been turning northbound onto South Nova Road with a green light when she almost hit two pedestrians — a man and a woman — after initially failing to spot them. The man then threw a cell phone at her car, shattering the windshield on her passenger side. 

The man told police that he and his fiancée were crossing the road and had the right-of-way, and that while they were crossing, the driver almost hit them with her car. He said he threw his phone at the car to "make it stop and because he was angry," the report states. 

He was arrested for "throwing a deadly missile into an occupied vehicle," in addition to a criminal mischief charge. He was taken to jail.
