The First Thing or The Second Thing?

2:20 a.m. Palm Coast S-Section

Burglary of an occupied dwelling, disorderly intoxication. A woman was asleep at home when someone started kicking her home’s front door and yelling threats, waking her.

He fled when deputies arrived, but a deputy caught him. The only items in his pockets were keys and three receipts — all from bars, and all from that morning. 

Deputies asked him what he was doing at the house, and he said he was dropped off for “a thing,” but wouldn’t elaborate on what that “thing” was. There were scuff marks on the door where he'd kicked it. Deputies arrested him.

‘The trunk isn’t part of the vehicle’

4:14 a.m. Flagler Plaza Drive  

Cocaine possession. A deputy noticed a man asleep at the wheel of a car which was parked, but running.

The deputy woke the man up, noticed a lighter and a beer bottle cap in the car, and asked to check the vehicle. The man said yes, and the deputy found marijuana residue. 

When the deputy opened the car’s trunk, the man slammed it shut, “stating that the trunk was not part of the vehicle.”

The deputy told him the trunk was part of the vehicle — and that, since he’d seen marijuana in the car, he had probable cause to search it. 

The deputy found cocaine, marijuana and a loaded gun, and arrested the man.
