Ormond-by-the-Sea condo owner shoots tenant over property dispute

Gary Moore, 60, was arrested Monday evening on charges of aggravated assault with a deadly weapon and possession of a firearm by a convicted felon.

Volusia County Sheriff’s Office arrested a condo owner in Ormond-by-the-Sea after he shot his tenant in the hand Monday night

Gary Moore, 60, first called deputies over a complaint he had about his tenant, Jorge Martinez. Moore told them he agreed to let Martinez live in the condo located in the 1500 block of Ocean Shore Boulevard if Martinez helped with renovations. VCSO reported Moore decided his tenant wasn’t fulfilling his end of the deal, and wanted to evict him.

However, deputies informed Moore that if Martinez had done some work renovating the condo already, he had to go through a civil eviction process. In response, Moore tossed all of Martinez’s property outside the front door.

VSCO returned to scene later that evening at approximately 6:32 p.m. because Martinez’s dogs were loose on the property. After rounding up the dogs, a deputy spoke to Martinez, who said he had paid to stay in the condo until the end of August. The deputy also told him the issue was a civil matter and to contact VCSO if he needed additional help.

As the deputy was leaving, Martinez broke one of the front windows of the condo, which was followed by the sound of a gunshot. After asking Martinez to approach him, the Volusia County deputy noticed a wound in Martinez’s left hand. He was transported to Halifax Health Medical Center for his injury.

The Ormond Beach Police Department joined VCSO in setting up a perimeter around the condo, and Moore came outside on his own.

Moore was transferred to the Volusia County Branch Jail, where he was charged with aggravated assault with a deadly weapon and possession of a firearm by a convicted felon — VCSO reported he has a previous conviction for aggravated assault with a deadly weapon in Texas dating back to 1978.

Moore remained detained Tuesday morning on a $20,000 bond.
