Case dismissed: State attorney won't prosecute Tavares

The State Attorney’s Office has dropped its charges against Cassimiro Tavares, a Palm Coast man who was accused in 2012 of stealing $24,801.13 from a Bunnell business.

Prosecutors announced a nolle prosequi during an Aug. 15 docket sounding for Tavares’ trial, meaning that they will no longer pursue the case. Attorneys did not immediately return calls asking for further explanation.

Tavares was hired in 2008 to manage the office of A&T Auto Repair, in Bunnell. In September of that year, Andrzej Tyminski, who co-owns the auto repair shop, said he noticed that funds in his bank account were depleted for unknown reasons. He accused Tavares of stealing between $2,800 and $4,500 per month from him and his business by forging signatures on checks. Tyminski estimated that about $50,000 was stolen from him.

Tavares was charged with five counts of forgery, one count of grand theft and one count of threat or extortion, a charge that arose when Tyminski told investigators that Tavares threatened to have Tyminski deported when Tyminski asked about a missing check book.

The charges against Tavares were filed in January 2012. After a year and a half and more than a dozen pretrial hearings, the case was closed after the docket sounding last week.
