Marijuana found in Miller's garage

Paul Miller, who admitted to the March 14 shooting of his neighbor, Dana Mulhall, had partially smoked marijuana cigarettes in his garage the night of the shooting, according to the report from the Flagler Beach Police Department.

A small pipe with burnt residue inside was also found, in addition to four oxycodone pills and a baggie of green, leafy substance and some rolling papers.

Miller has been charged with second-degree murder, though the State Attorney’s Office is still investigating and has yet to determine whether it will prosecute. Miller maintains that he felt threatened by Mulhall, with whom he has had disagreements in the past.

Miller told police officers that Mulhall shouted profanities at him. Miller then retrieved his 9 mm handgun from his home and went back outside. Mulhall was shaking the fence that separated the yards of their Flagler Beach homes.

According to the report: “(Miller) claimed that at no time did he pull the gun out or tell the victim that he had a gun. However, he stated that the victim said that he had a gun ‘too’ and would kill both the defendant and his dogs.

“The defendant claimed that the victim then reached behind his back in the buttocks area, at which point the defendant stated that he felt the neighbor was reaching for a gun. He stated that he then pulled his gun out of his pocket and began to shoot at the victim. The defendant stated that after the first shot, the victim turned and retreated by running toward the front door of the victim’s home.

“The defendant stated that even after the victim attempted to retreat, he continued to shoot at the victim until the victim fell to the ground.” Five shots were fired in all.

At that point, Miller called 911.

Several witnesses stated that they heard the shots, describing them as “slow,” “methodical” and “evenly spaced.”

Miller is currently in the Flagler County Inmate Facility.
