Judge C. McFerrin Smith III has been assigned in the case of Francoise Pecqueur's death. Catherine Vyvyan, of Jacksonville, is filing the suit, alleging wrongdoing in Pecqueur's behalf.
The case is still under investigation by the Florida Highway Patrol.
Michael P. Koller is the main attorney assigned to the case, according to the Flagler Clerk's website. A fee of $400 was paid Dec. 6 to begin the suit.
As was previously reported, Pecqueur, 76, was walking in the C-section of Palm Coast Nov. 10, when she was struck and killed by Jamesine A. Fischer, 55, in a PT Cruiser.
According to a report from the Florida Highway Patrol, the incident occurred at 6 p.m. Nov. 10 on Columbia Lane, near Colechester Lane. Jamesine Fischer was traveling northbound and for an unknown reason did not see Pecqueur.
The vehicle struck Pecqueur and propelled her onto the east shoulder of the road.
Fischer is the wife of Flagler County School Board member John Fischer.
