A second lawsuit has been filed against Mohammed Ansari, the owner of the Mobil gas station where Zuheily Rosado was shot and killed in February — this one filed by Rosado’s family on charges of wrongful death and negligence.
About a week before Rosado was killed, a man walked into the gas station and told her during an argument that he would soon return to kill her, according to a complaint filed. That argument was overheard by Ansari, the complaint says.
Then, on Feb. 21, a man walked into the gas station, where Rosado was working alone, and fired several shots at her. He turned and left without taking anything. The incident lasted less than 30 seconds.
“Ansari had a duty to take precautions as reasonably necessary to protect (his) employees from imminent criminal attacks for which (he) was aware and for which are reasonably certain to occur,” the complaint reads.
Ansari is already facing charges of workers’ compensation fraud in a separate, criminal case filed by the State Attorney’s Office because Ansari did not have workers’ compensation insurance at the time of Rosado’s death, which is considered a workplace accident. Ansari was arrested on those charges last week, but was released the next day on $1,000 bond. His felony arraignment for that case is set for June 17.
The new case was filed Thursday by Rosado’s former husband, Ulises Angel, and his attorney, John M. Phillips. It is a civil, rather than a criminal case, and it also charges Ansari with fraud for failing to have workers’ compensation insurance when Rosado died.
Ulises’ complaint also accuses Ansari of gross negligence because gas stations are frequently targeted for crime, especially at night, and the store lacked adequate security to “protect its employees and guests,” the complaint says.
Rosado’s shooter has not yet been identified.
