Moments after Paul Miller shot his neighbor March 14, he called 911 to report the incident. After speaking with dispatch for 2 minutes, 36 seconds, Miller hung up the phone, saying he needed to call his wife.

Miller was arrested two days later and charged with second-degree murder for shooting and killing Dana Mulhall, 52, in a Flagler Beach neighborhood.

The investigation by the State Attorney’s Office and the Florida Department of Law Enforcement determined Miller fired the five shots that struck Mulhall. Miller is being held without bond in the Flagler County Inmate Facility.

The 911 call went as follows:

Dispatch: “Flagler County 911, where is your emergency?”
Miller: “You might send an ambulance.”
...
Miller: “He’s laying in his yard over here. … We’ve had trouble before.”
Dispatch: “OK, is he, and where are you right now?”
Miller: “I’m in the house, my house.”
Dispatch: “Where’s the gun.”
Miller: “Huh?”
Dispatch: “Where is your gun?”
Miller: “Laying outside.” (a nervous laugh) “On the porch.”
Dispatch: “OK, so we don’t know if he’s breathing or anything?”
Miller: “Nope. Don’t know.”
Dispatch: “OK, are you going to stay in your house?”
Miller: “Yeah, I’ll be out here on the porch.”
Dispatch: “OK, is anybody out with him?”
Miller: “Nope.”
Dispatch: “Do you know the male’s name?”
Miller: “His first name’s Dana. I don’t know his last name.”
Dispatch: “OK.”
Miller: “He made threats here a couple of weeks ago and I had to call law on him. He come over here doing it again right just a few minutes ago.”
Dispatch: “What happened?”
Miller: “He says my dogs was barking. And they do yap a little bit as the dogs walk up the street but he’s drunk or something and his face is blood red and he’s just cussing and calling me names and threatening me and every damn thing.”
Dispatch: “OK.”
Miller: “Calling me names. Threatening.”
Dispatch: “OK, and what is your — what is your name, sir? … OK, and you’re on the porch and your gun is on the porch with you?”
Miller: “Yeah.”
Dispatch: “OK, I want you to leave the gun alone. Is it emp— Did you unload it?”
Miller: “I think I did.”
Dispatch: “OK, all right. Where is the — where are you putting the gun?”
Miller: “Out through the back of the house.”
Dispatch: “OK.”
Miller: “Probably outside.”
Dispatch: “OK. All right, put — ”
Miller: “I’m going to call my wife and tell her what’s happening. She’s … ”
Dispatch: “OK, I need to know like where you’re going to put the gun in the home.”
Miller: “I put the gun in the living room on top of the cabinet.”
Dispatch: “OK. And you’re calling … OK, do you know his — house — where he is?”
Miller: “He lives next door here.”
Dispatch: “Just next door?”
Miller: “Yeah.”
Dispatch: “OK. OK, I’m going to probably have to keep you on the line though until we can get law enforcement–”
Miller interrupts: “No, I gotta, I gotta hang up and call my wife. I’ll be right here on the porch.”
Dispatch: “He just hung up on me.”
