Paul Miller was charged with shooting his neighbor, Dana Mulhall.
The two men live on South Flagler Avenue, in Flagler Beach. They share a fence. Today, Paul Miller is in jail for shooting his neighbor, Dana Mulhall.
The incident occurred at 6:15 p.m. Wednesday. Mulhall, a white male, arrived home from Poor Walt’s and got into an argument about Miller’s barking dog. The State Attorney’s Office and the Florida Department of Law Enforcement conducted an investigation, Flagler Beach Police Chief Dan Cody said, in which they learned Miller brought out a 9 mm handgun. Miller told officers that Mulhall made a gesture that he interpreted as threatening, and Miller fired five shots, three of which hit Mulhall. Miller was not arrested right away because of questions surrounding Mulhall’s gesture and whether Mulhall had threatened Miller. They have had arguments in the past.
“Was it self defense? Was he in fear for his life? Was the guy armed?” Cody said. “All these things put together, they were kind of hesitant about taking any action at the time.”
But after the investigation was complete, Miller was charged with second-degree murder, which means it was not deemed premeditated.
Cody said Miller did admit to the shooting, and the gun was in Miller’s house. Paul Miller is 6-foot-3, retired and was born in 1946. He lives at 1340 S. Flagler Ave.
