Flagler Beach Police Chief Dan Cody said the State Attorney’s Office is waiting on the autopsy before pressing charges. He confirmed that Paul Miller shot and killed Dana Mulhall at around 6:15 p.m. Wednesday, after an argument about a barking dog.

Mulhall, a white male from Flagler Beach, arrived home from Poor Walt’s yesterday evening, Cody said.

“He started hollering to the next door neighbor, that he was going to kill him and kill his dog,” Cody said. “Mr. Miller came outside with his gun, and they argued, and Mr. Miller shot Mr. Mulhall. There were five shots, and we know of him being struck three times, pending the autopsy.”

There were no witnesses, but there were some residents who heard the shots, Cody said.

Miller was not arrested. The officials from the State Attorney’s Office and the Florida Department of Law Enforcement arrived on the scene last night and determined they would await results of the autopsy.

Cody said there is no doubt that Miller did shoot Mulhall, though.

“Miller said so,” Cody said. “The gun’s in his house.”

He added that there have been a few disturbances between these residents in the past.

There hasn’t been a murder in Flagler Beach in several years, Cody said.
