FHP: ‘Sheriff was confused of the actual date’ of calls with Fischer.

Neither Flagler County Sheriff Donald Fleming nor Flagler County School Board member John Fischer will be investigated in connection with the death of Francoise Pecqueur, according to the Florida Highway Patrol.

Fischer’s wife, Jamesine Fischer, was driving her PT Cruiser Nov. 10, on Columbia Lane, when she hit Pecqueur. She was arrested Feb. 24 and charged with leaving the scene of a crash involving death and faces up to 30 years in prison. She posted $30,000 bond and was released.

The lack of clarity surrounding the sequence of phone conversations between Fleming and John Fischer in regard to the Nov. 10 accident prompted the FHP to review Fleming’s phone records.

But after follow-up interviews with Fleming, the FHP was satisfied.

“There is nothing to investigate,” FHP Lt. Justin Asbury said Monday. “This crash involved a hit-and-run where Mrs. Fischer was the driver, subsequently misled authorities, and was arrested. No evidence has arisen to show the sheriff or the husband took part in her failure to comply with the crash statute.”

‘The sheriff was confused’
According to the FHP’s Traffic Homicide Investigation report, Fleming said in a Jan. 31 sworn statement to FHP Cpl. Brian Wood that he spoke with John Fischer around 4:58 p.m. Nov. 10 “about business matters.”

Then, a second call was received at 6:48 p.m., approximately 48 minutes after Jamesine Fischer hit Pecqueur.

“Sheriff Fleming stated he had bad reception, but that Mr. Fischer stated his wife had hit an animal and asked what he needs to do to report it,” the report states.

Fleming told Fischer he would call back when he got better reception, according to his statement.

Fleming then called Fischer at 7 p.m., “and advised him to call the dispatch center and report the crash.”

The crash occurred at about 6 p.m. Nov. 10.

“When asked if he knew why there would have been such a long delay between the crash and reporting it, Sheriff Fleming stated, ‘I don’t know unless alcohol was involved,’ but he doesn’t know the Fischers to drink,” the report states.

But the day after the sworn statement to the FHP, Fleming made a phone call to Wood, and said he had a written amended statement. In the new statement, Fleming said the first conversation he had about the the crash didn’t occur until 5:30 a.m. Nov. 11, the day after the incident.

The FHP report states that, according to phone records, Fischer called the Flagler County Sheriff’s Office at 5:34 a.m. Nov. 11, just four minutes after speaking with Fleming.

The other calls involving bad reception occurred at 6:48 and 7 p.m. Nov. 11, rather than Nov. 10, Fleming said.

“Sheriff Fleming called Mr. Fischer the night of Nov. 11, 2011, to follow up on the conversation from the morning,” the report states.

Still unclear on Fleming’s recollection, Woods made a Feb. 6 visit to the Flagler County Sheriff’s Office to clarify the sequence with Fleming.

“The first interview was given to me on Jan. 31, 2012, prior to Sheriff Fleming having his phone records in hand ... the sheriff was confused of the actual date that Mr. Fischer had called him,” Woods wrote in the report.

Woods then reports that he received Fleming’s phone records, “which clearly show that Mr. Fischer called (Fleming) the day after the collision, not the day of the collision.”

Jamesine Fischer intends on pleading “not guilty” to the hit-and-run charges, according to her attorney, Steven Alexander. A trial date has not been scheduled.
