Many questions still surround the Nov. 10 death of Francoise Pecqueur. But one thing is for certain: Jamesine Fischer’s insurance company will pay $1.25 million to Catherine Vyvyan for the wrongful death of Pecqueur, her mother.
Allan Ziffra, Vyvyan’s attorney in the wrongful death suit, said the case was settled for the maximum in the State Farm policy.
The incident occurred sometime before 6 p.m. Nov. 10, near Colechester and Columbia lanes, in Palm Coast. Ziffra said a 911 call was logged at 6:08 p.m. from a witness who confirmed Fischer was at the scene and was “confused and incoherent.” Fischer herself didn’t have the incident reported until about 12 hours later.
“We determined that running over someone and not reporting it for so long was reckless disregard for human safety,” Ziffra said. “The egregious nature of her conduct would have enflamed a jury and would have driven up any potential verdicts. And based on that, State Farm did what they should have done by protecting the insured and settling for the policy limit.”
There were no punitive damages considered in the case.
