According to attorney Michael Chiumento III, who represented the Ocean Hammock Property Owners Association, a judge has ruled that the Ginn Corp. does not have the right to build a proposed 561 units on its property in front of the Ocean Towers, at the end of 16th Street, in the Hammock.
Ginn also wanted to extend its buildout date on the development of regional impact; that request was also denied.
The ruling confirms the opinion of the Flagler County Board of County Commissioners, which ruled April 2010 that the property owners who bought condos in the Ocean Towers would have their views of the ocean preserved.
The judge, Chiumento said, “supports the conclusion that the revisions proposed are not consistent with the comprehensive plan.”
Chiumento added that Ginn does not plan to give up and is preparing further appeals.
